Here for You, Not the Insurance Company

Rideshare (Uber & Lyft) Accident Lawyers in Chicago, Illinois

Insurance Companies Have a Team.
You Should Have One Too.

Insurance companies bring adjusters, investigators, and lawyers to every serious claim. Claims are evaluated to control cost, not to make you whole. We’ve handled these claims for injured people across Illinois since 1992 — and we know how to build a case the insurance company has to take seriously.

Attorney David Monteleone — practicing personal injury law in Illinois since 1992

Crashes happen every day on I-90, I-39, US-20, and the local roads Illinois families drive to work and school. Within days — sometimes hours — an adjuster will call, and what you say in that first conversation can shape the rest of your claim.

After an accident, it's crucial to consider:

  • ✓ Was the collision caused by someone else's negligence?
  • ✓ Did the crash result in serious injury or property damage?
  • ✓ Will your insurance settlement adequately cover medical treatment costs and lost income?

At Fisk & Monteleone, we gather the evidence, deal with the insurance company, and take your case to court if that’s what it takes.

You Don't Have to Face the Insurance Companies Alone: Get Illinois's Rideshare Accident Legal Experts on Your Side

Rideshare accidents are different from typical car crashes. As a passenger in Illinois, you're protected by strong state laws that require substantial insurance coverage from companies like Uber and Lyft. Under the Illinois Transportation Network Providers Act, rideshare companies must maintain $1 million in coverage for passengers during trips.

After a rideshare accident, these questions matter most:

  • Which insurance covers your injuries? Personal auto insurance, rideshare coverage, or both? In Illinois, rideshare companies must provide $1 million in coverage for passengers during trips. Understanding which policy applies is crucial for your recovery.
  • Have you documented everything about your ride? Your rideshare app receipt, trip details, and accident location are vital pieces of evidence that can impact your claim's success.
  • Are you getting the full compensation you deserve? Beyond immediate medical bills, you may be entitled to compensation for ongoing treatment, lost wages, and other accident-related expenses.

Time matters in these cases. Illinois law gives you two years to file an injury claim, but waiting can make it harder to gather critical evidence. Your driver's insurance, the rideshare company's coverage, and other involved parties' policies may all come into play.

At Fisk & Monteleone, we understand the unique challenges of rideshare accident claims in Illinois. We know how to navigate the complex web of insurance coverage and corporate policies that make these cases different from regular car accidents.

Let us handle the insurance companies and legal complexities while you focus on recovery. Contact our office for a free consultation to understand your options under Illinois law. Your health and fair compensation are our priorities.

What You Can Recover

Compensation After an Illinois Car Accident

Illinois is an at-fault state: the driver who caused your crash — and their insurance company — is responsible for what it costs you. Even if you were partly at fault, Illinois’s comparative negligence rules let you recover as long as you were 50% or less to blame.

Economic Damages

  • Emergency care, surgery & hospital bills
  • Ongoing therapy & rehabilitation
  • Lost wages & future earning capacity
  • Vehicle repair or replacement

Non-Economic Damages

  • Pain and physical suffering
  • Disfigurement & permanent scarring
  • Loss of a normal life
  • Loss of consortium & companionship

Don’t wait: most Illinois car accident claims must be filed within two years — and claims against government entities can have far shorter deadlines.

Common Questions

Illinois Car Accident FAQ

How does rideshare insurance work in Illinois?

Coverage depends on what the driver was doing. Under the Illinois Transportation Network Providers Act, Uber and Lyft must carry $1 million in coverage while a passenger is in the car or a ride is underway. If the app was on but no ride was accepted, lower company coverage applies — and with the app off, only the driver’s personal auto policy is in play. Sorting out which policy pays is often the biggest fight in these cases.

How long do I have to file a car accident claim in Illinois?

In most cases, Illinois law gives you two years from the date of the crash to file a personal injury lawsuit (735 ILCS 5/13-202). Some claims — like those against a city or government entity — have much shorter deadlines. Evidence disappears fast, so the sooner you talk to a lawyer, the stronger your case.

What if the other driver doesn’t have insurance?

Illinois requires every auto liability policy to include uninsured motorist coverage, and many drivers also carry underinsured motorist coverage. That means you may still be able to recover through your own policy. We review every policy that could apply to your crash to identify the coverage available to you.

Can I still recover if the accident was partly my fault?

Usually, yes. Illinois follows modified comparative negligence: as long as you were 50% or less at fault, you can recover — your award is simply reduced by your percentage of fault. Insurance companies love to exaggerate your share of the blame, which is exactly why you shouldn’t accept their version of events.

How much is my car accident case worth?

It depends on the severity of your injuries, your medical bills, lost income, and how the crash affects your future. One client came to us after the insurance company offered her $500 — we recovered $45,000. The only way to know what your case is really worth is a free case review.

What does a car accident lawyer cost?

Nothing up front. We handle car accident cases on a contingency fee — our fee comes out of the recovery we win for you. If we don’t win, you don’t pay. Your first consultation is always free and confidential.

What should I do after a car accident in Illinois?

Get medical attention right away, even if you feel okay — some serious injuries have delayed symptoms. Report the crash, photograph the scene and vehicles if you can, and get contact information for witnesses. Then talk to a lawyer before you give a recorded statement or accept any offer from an insurance adjuster.
